Terms of Service

The web pages available at qualisend.com, the Qualisend application at app.qualisend.com, and all linked pages, APIs, and services (collectively, the “Site”) are owned and operated by Qualisend (“Qualisend,” “we,” “us,” or “our”). These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the Site and all services provided through the Site.

By creating an account, accessing the Site, or using any of our services, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Acceptable Use Policy, all of which are incorporated into this Agreement by reference. If you do not agree to these Terms, you must not access or use the Site or any of our services. These Terms constitute a legally binding agreement between you and Qualisend. You represent that you have the legal authority to enter into this Agreement. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Qualisend is an email verification platform that enables users to check the validity and deliverability of email addresses in real time and in bulk. Our services include single-address verification, bulk list verification via CSV upload, a verification API, syntax, DNS/MX, disposable, role, and catch-all detection, SMTP mailbox checks, a deliverability confidence score and status classification (deliverable, risky, undeliverable, and unknown), and tools to review and export your results.

Your access to and use of the Site may be interrupted from time to time due to equipment malfunction, updating, maintenance, repair, or other reasons within or outside our control. Qualisend reserves the right to suspend or discontinue the availability of the Site and/or any service at any time at its sole discretion. We will make commercially reasonable efforts to provide advance notice of any planned downtime or service discontinuation.

To use the services, you must create an account by providing a valid email address and password. Account creation is available via email and password only. We do not offer third-party authentication methods (such as Google or social media sign-in) at this time. You represent and warrant that all registration information you provide is accurate, complete, and current at all times, that you will maintain and promptly update your registration information, that you are at least 18 years of age or the age of majority in your jurisdiction, and that you will maintain the confidentiality of your account credentials and will not share your login details with any third party.

Qualisend offers multiple plans, including a free plan with a limited allowance of verification credits and paid plans with larger credit allowances and additional features. Credits are the unit of usage: each verification consumes credits from your workspace balance. Current plan details and pricing are available at qualisend.com. All payments are processed through Stripe. By subscribing to a paid plan, you authorize Qualisend to charge your payment method on a recurring basis until you cancel your subscription. All fees are quoted and charged in U.S. Dollars (USD) unless otherwise stated.

Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. Qualisend reserves the right to change pricing at any time with at least thirty (30) days advance written notice via email. If you do not cancel your subscription before the new pricing takes effect, your continued use constitutes acceptance of the updated pricing. Payments are non-refundable except where required by applicable law. If you believe you have been charged in error, contact hello@qualisend.com within fourteen (14) days of the charge.

You agree to use the services only for lawful purposes and in compliance with these Terms, our Acceptable Use Policy, and all applicable laws and regulations. You agree not to use the services to submit email addresses or lists that you do not have a lawful basis or right to process; to send, display, or distribute any illegal, harmful, or objectionable content; to send unsolicited commercial communications (spam) or violate applicable anti-spam laws including CAN-SPAM, GDPR, and CASL; to upload content that infringes intellectual property rights; to attempt unauthorized access to any part of the services; to use automated tools, bots, or scrapers against the Site without prior written consent; to interfere with or disrupt the services or the integrity of our verification infrastructure; to transfer or share your account with any third party; or to use verification results to facilitate harassment, phishing, fraud, or unlawful contact. Violation of these provisions may result in immediate suspension or termination of your account without prior notice.

You retain all ownership rights in any email addresses, lists, files, text, and other materials you upload to or create using Qualisend (“Your Content”). By uploading Your Content to Qualisend, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and process Your Content solely to the extent necessary to provide, maintain, and improve the services. This license terminates when you delete Your Content or when your account is terminated. You are solely responsible for Your Content and represent that you have all necessary rights and permissions to use it through the services.

Qualisend may integrate with third-party platforms and services (such as email service providers, CRMs, and other data tools). Your use of these third-party services is governed by their respective terms of service and privacy policies. Qualisend is not responsible for the availability, accuracy, or practices of any third-party services and makes no warranties regarding their performance or security. When you connect Qualisend to a third-party service, you authorize us to access and exchange data with that service to the extent necessary to provide our services.

Qualisend processes the email addresses and associated data you submit for verification solely to perform the verification you request and to return the results to you. We do not sell, rent, or share your lists, and we do not use them to build shared or third-party datasets. Qualisend is committed to compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. As a data processor acting on your behalf, we process data only as necessary to provide the services you have requested. You, as the data controller, are responsible for ensuring you have a lawful basis for processing the personal data you submit. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUALISEND DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. VERIFICATION RESULTS ARE BEST-EFFORT ASSESSMENTS BASED ON THE SIGNALS AVAILABLE AT THE TIME OF THE CHECK; QUALISEND DOES NOT WARRANT THAT ANY RESULT IS ACCURATE OR COMPLETE, OR THAT AN ADDRESS CLASSIFIED AS DELIVERABLE WILL SUCCESSFULLY RECEIVE MAIL. QUALISEND DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUALISEND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL. IN NO EVENT SHALL QUALISEND’S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO QUALISEND IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

You agree to defend, indemnify, and hold harmless Qualisend, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the services, Your Content, your violation of these Terms or any applicable law, your violation of any third party’s rights including intellectual property, privacy, or publicity rights, and any claim that Your Content caused damage to a third party.

These Terms are effective from the date you first access or use the services and continue until terminated by either party. You may cancel your subscription and terminate your account at any time through your account settings or by contacting hello@qualisend.com. Cancellation will take effect at the end of your current billing cycle. Qualisend may suspend or terminate your account at any time for breach of these Terms, fraudulent or unlawful activity, non-payment of fees, or extended inactivity (with thirty days’ notice). Upon termination, your right to access the services will immediately cease, any outstanding fees become immediately due, and Qualisend will delete Your Content within thirty (30) days unless retention is required for legal purposes. You may request an export of Your Content prior to termination.

Before initiating any formal dispute resolution proceedings, you agree to first contact Qualisend at hello@qualisend.com and attempt to resolve the dispute informally for at least thirty (30) days. These Terms and any disputes arising out of or relating to these Terms or the services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in the State of Delaware. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

By creating an account or using Qualisend, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

Qualisend reserves the right to modify these Terms at any time. We will notify you of material changes by sending an email to the address associated with your account and/or by posting a prominent notice on the Site at least thirty (30) days before the changes take effect. Your continued use of the services after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the services and cancel your account before the changes take effect.

These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Qualisend with respect to the services and supersede all prior or contemporaneous agreements. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. The failure of Qualisend to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms without the prior written consent of Qualisend. Qualisend may assign these Terms without restriction. Qualisend shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, internet or infrastructure failures, or strikes.
